This website is operated by Omnis Festival (ABN 52 177 621 427), trading as Omnis. In these terms, “we”, “us” and “our” mean that entity, and “you” means you, the person using this website.

2. Accepting these terms

By accessing or using https://omnisfestival.com.au, you agree to these terms. If you don’t agree to them, please don’t use the site.

We may update these terms from time to time. The version published on this page at the time you use the site is the version that applies. The “last updated” date at the top of this page tells you when it last changed. Material changes affecting an existing ticket holder will be notified by email where we hold your address.

Tickets are sold by 123tix. Your purchase is also subject to 123tix’s own terms and privacy policy, which you should read before you buy.

4. Using this website

You agree not to:

• use the site for any unlawful purpose, or in a way that breaches anyone else’s rights;
• attempt to gain unauthorised access to the site, its server, or any connected system;
• introduce malicious code, or interfere with the site’s normal operation;
• scrape, harvest or systematically extract content or data from the site without our written permission;
• use automated tools to purchase tickets, or resell tickets in breach of the Ticket Terms.

5. Intellectual property

All content on this site — including the Omnis name and marks, text, layout, design, graphics, and the generated visual artwork — is owned by us or used under licence, and is protected by the Copyright Act 1968 (Cth) and other laws.

You may view the site and print or download extracts for your own personal, non-commercial use. Any other use — copying, reproducing, republishing, modifying or distributing — requires our prior written permission.

6. Accuracy of information

We take reasonable care to keep information on this site accurate and current. Some information — lineup, set times, last entry, running order and pricing — is inherently subject to change, and we may change it without notice.

Where a change materially affects the event you bought a ticket for, your rights are set out in the Ticket Terms and under the Australian Consumer Law.

7. Links to other sites

This site links to third-party sites, including 123tix and mapping and social media services. We don’t control those sites and aren’t responsible for their content, availability, or privacy practices. A link is not an endorsement.

8. Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a term of ours would do so, it does not apply to that extent.

9. Limitation of liability

Subject to clause 8, and to the extent permitted by law:

• this website is provided on an “as is” and “as available” basis, and we don’t warrant that it will be uninterrupted or error-free;
• we are not liable for indirect or consequential loss arising from your use of this site;
• where our liability can be limited but not excluded, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our Privacy Policy.

11. Governing law

These terms are governed by the laws of Tasmania, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Tasmania and the courts able to hear appeals from them.
